Billionaire couple wins moth lawsuit — ApsnyNews World News

A British judge has granted a couple a refund on their purchase of a £32.5 million ($40 million) mansion found to have been infested with moths.

Iya Patarkatsishvili, daughter of Georgian billionaire tycoon Badri Patarkatsishvili, and her husband Yevhen Hunyak bought the seven-bedroom London mansion from former professional rower William Woodward-Fisher in 2019, and soon discovered the infestation, according to court documents filed on Monday.

The couple’s legal team told the court that Patarkatsishvili and her family were swatting away a 100 moths a day, according to the BBC. Hunyak told the court that the insects were landing on their children’s’ toothbrushes, food plates and in their drinks. They also claimed around £15,000 worth of damage to clothes.

The source was eventually found to be the building’s woolen insulation, which the pests had infested.

The judge found that Woodward-Fisher lied in his answers about the state of the property prior to its sale, and failed to disclose “a very serious infestation.”

“He simply wanted to sell the house and move on,” the judge said.

“As he admitted in cross-examination, disclosure of the infestation would likely have caused the sale to go off, and he would have been left needing to move out of the house and do expensive works (which later took the Claimants’ contractors nearly six months in total to complete) to remove all the woolen insulation,” the judge added.

The heiress and her husband were demanding a full refund on the purchase, £3.7 million to account for land tax, as well as hundreds of thousands of pounds to account for damages and money spent on exterminators.

The judge ruled the billionaire couple be refunded the cost of the home, subtracting an amount for the years they spent living there, according to a press release from the British Judiciary. They will also be refunded the tax, and substantial damages and costs incurred as a result of infestation problems.

The exact award amount, as well as other terms of relief, will be determined at a court hearing later in the month, the press release said.

Iya Patarkatsishvili inherited a portion of her father’s estate after his death in 2008. Forbes had valued Badri Patarkatsishvili’s fortune at around $12 billion.
